Terms

Lead times and fabrication times

 Lead times are subject to change. It is the customers responsibly to email sales@commercialdoorhardwareinc.com to check on lead times and availability. Stock orders ship within 5-7 business days unless otherwise noted. Non stock items may fall into the 2-3 week or 4-6 week lead times column. Next day, 2nd day , or 3rd day orders on stock items ship within 48-72 hours after receipt of order. If there is a delay longer than those 24-48 hours a customer service rep will be in contact immediately to convey all applicable options. If you have a special request feel free to call as same day shipments can be arranged for an additional charge if available.

 

Order processing

Orders will be processed within 24 hours of order placement.  Orders cancelled before 24 hours will incur a 20% order processing fee if processed. Any cancellations after 24 hours of placement will not be accepted. Standard processing and ship time for in stock orders is 3-5 business days.  Next day, 2nd day , 3rd day orders will be shipped within 2-3 business days unless otherwise noted. The customer will be contacted otherwise. Stock is subject to change at any time.

 

Cancellations

All products order cancellations, if not prohibited above, must be approved by CommercialDoorHardwareInc.com, and may be denied or subject to restocking fees and other charges. Restocking and cancellations fees are subject to change and range from 40%-60%.

 

Returns / Cancellations

No returns can be accepted on special order products and or products not marked In stock on CommercialDoorHardwareInc.com. Special order products are not marked in stock on CommercialDoorHardwareInc.com

Ligature Resistant Locks, Hinges and Closers are non-returnable.

Electrified Hardware , Custom keyed locks, Custom fabricated hardware are all non-returnable or cancelled after 24 hrs of order placement.

Please note that all custom orders are sold on a "Final Sale" basis only! No cancellations, returns, refunds or credits are permitted and will be marked on your quote if quoted or will not be shown in stock on CommercialDoorHardwareInc.com

 

Expedited orders  

There are absolutely no returns, cancellations on expedited 2nd day, next day or 3 day orders.

International / Canada

Minimum purchase restriction and / or additional processing fees may apply.. Customers are responsible for all custom and Duty fee’s levied by their inhabited Countries.CommercialDoorHardwareInc.com is not responsible for Duties and taxes.

 

Special orders/Custom products

 Items not marked In stock on CommercialDoorHardwareInc.com are special order items. Lead times may vary. There are no cancellations or returns on sourced or special ordered items.

Shortages 

Any report of shortages must be made to CommercialDoorHardwareInc.com within 1 business day of signed receipt. Any cancellation request maybe denied or subject to restocking fees.

 

Approved returns 

You must contact us to request an RGA number in advance of returning any product! Packages that arrive without the RGA number prominently displayed on the outside of the carton may be refused and returned to you unopened. It is strongly recommended that you declare value when returning material to us that is worth more than $100 as most carriers will not cover losses over that amount without additional insurance.

 

No third party benefit

The provisions stated herein are for the sole benefit of the parties hereto, and confer no rights, benefits or claims upon any person or entity not a party hereto.

 

Waiver, Choice of Law and Venue

The failure of either part to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent non-performance of any such term or condition by the other party. All transactions shall be governed by the State of New York, excluding its conflict of law rules, and to the extend allowed under these terms and conditions , both Quality Door & Hardware Inc. and Customer agree that venue shall be proper in the state courts in Suffolk County, New York or Federal courts for the Long Island District.

 

Claims Damaged defective hardware.

All claims for hidden damage must be made within 5 days of receipt of goods. If a package arrives in an obviously distressed condition, you may refuse the shipment or sign for the package as damaged. The carrier will be required to cover any merchandise loss incurred. Customers are responsible for reporting damaged boxes directly to the carrier and refuse the shipment.

 

Shipping    

CommercialDoorHardwareInc.com has the right to designate carriers on all shipments. The customers are responsible for filing a freight claim directly with the carrier once the material is signed for and accepted directly with the carrier.

Payment

We accept payment by Visa, Master card and American Express, Discover and Paypal.

Pricing

Prices are subject to change without notice. Due to frequent manufacturer price adjustments based on metal cost fluctuations, pricing is guaranteed only at the time an order is placed.

 

Sales Tax

Orders shipped to New York State are subject to local sales tax. If you are ordering for an exempt organization or for resale, please contact us directly prior to making your online purchase. Exempt or resale certificates must be faxed to us at 718-789-8346.

Customers shall have no right, title. or interest in the trade names, trademarks, trade dress, copyrights, patents, domain names, product names, catalogs, or any other intellectual property right (“IP”) reserved by Quality Door & Hardware Inc. , or any IP owned by manufactures and/or suppliers of CommercialDoorHardwareInc.com. Customers shall have no right to use or copy any IP of CommercialDoorHardwareInc.com or its manufacturers and or suppliers without CommercialDoorHardwareInc.com express written consent.

Sourced Products

Sourced Products are priced according to current market conditions on a per product basis. There are no returns on sourced material. There are no returns or cancellations on sourced products. Sourced products are not marked in stock on our CommercialDoorHardwareInc.com website. Restocking fees vary.

 

Assignment

Customer shall not assign any order, or any interest therein, without prior written consent of CommercialDoorHardwareInc.com. Any actual or attempted assignment without Quality Door & Hardware Inc.’s approval shall entitle CommercialDoorHardwareInc.com to cancel such order upon notice to customer.

Force Majeure

Quality Door and Hardware Inc shall not be liable for any delay in, or impairment of, performance resulting in whole or in part from any force majeure event, including but not limited to acts of God, labor disruptions , acts of war, acts of terrorism, governmental decrees or controls, insurrections, epidemics , quarantines, shortages, communication or power loss, fires, accidents, explosions, inability to procure or ship product or obtain permits and licenses, inability to procure supplies or raw materials, or any other circumstance beyond the reasonable control of CommercialDoorHardwareInc.com (Quality Door & Hardware Inc.)

Severability

If any or portion of these terms and conditions is found to be invalid or unenforceable, the invalid or unenforceable term shall be severed from these terms, and the remaining terms and conditions shall be valid and fully enforceable as written.

 

Authorization

Business Customers represent that any person accepting these Terms of Sale on behalf of the Business Customer is authorized to do so and that all employees and representatives of the Business Customer who access CommercialDoorHardwareInc.com or any other CommercialDoorHardwareInc.com website on behalf of the Business Customer or otherwise purchase products from CommercialDoorHardwareInc.com on behalf of Business customer have the legal right, and are duly authorized , to match such purchases and further authorized to enter into agreements relating to the purchase of products or to obtain pricing or discounts from CommercialDoorHardwareInc.com on behalf of Business Customer. Business customers hereby agree to indemnify or hold Quality Door and Hardware Inc. harmless against any breach of this representation.

 

Limited of Liability

 CommercialDoorHardwareInc.com (Quality Door and Hardware Inc.) and Third-Party providers expressly disclaim any liability for consequential, incidental, special, exemplary or punitive damages in the performance of services. The liability of CommercialDoorHardwareInc.com or Third Party provider performing

Services in all circumstances is limited to, and shall not exceed, the purchase price for the performance.

 

Indemnity

Business Customers shall defend, indemnify and hold harmless Quality Door & Hardware Inc., Third Party providers, and their respective officers, directors, employees and subcontractors from and against any al all claims, suites, liabilities, damages, settlements, charges, taxes and any other losses or expenses for physical injury to, illness or death of , any third party regardless of status and damage to or destruction of any tangible property which the third party many sustain or incur.

 

Governing, Law: Limitations

The rights and obligations of the parties under these terms and conditions shall not be governed by the 1980 United Nations Convention of contracts for the International Sale of Goods. Rather, these terms and conditions shall be governed by the laws of the State of New York, U.S., including its provisions of the Uniform Commercial code, but excluding its conflict of law rules.
